1. Acceptance of Terms

These Terms govern your use of AI Security Guard. By using the Service, you agree to them. If you don't agree, that's okay—just don't use the Service.

If you're using this on behalf of a company or organization, you're confirming you have authority to agree to these Terms on their behalf.

The legal version: These Terms of Service ("Terms") constitute a legally binding agreement between you and Enspektos, LLC ("Company," "we," "us," or "our") governing your use of AI Security Guard ("Service") available at aisecurityguard.io.

2. Description of Service

AI Security Guard provides AI- and machine learning-powered security scanning services for content submitted by users and AI agents. The Service analyzes content for potential security threats including, but not limited to, prompt injection attacks, code injection, credential exposure, data exfiltration attempts, and social engineering.

The Service returns security assessments, threat verdicts, and recommendations based on automated analysis. The Service is designed to assist in security decision-making but does not guarantee detection of all threats or prevention of security incidents.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Your Content

4.1 Ownership

You retain all right, title, and interest in and to any content you submit to the Service for scanning ("Your Content"). You also retain all right, title, and interest in the scan results and outputs generated from Your Content ("Output").

4.2 License Grant

By submitting Your Content to the Service, you grant us a limited, non-exclusive, royalty-free license to access, process, and analyze Your Content solely as necessary to provide the Service. This license terminates upon deletion of Your Content (within 15 minutes of submission).

4.3 Your Responsibilities

You are solely responsible for:

• All content you submit to the Service
• Ensuring you have the right to submit content for scanning
• Your use of scan results and any actions taken based on those results
• Complying with all applicable laws and regulations in your use of the Service

4.4 Prohibited Content

You agree not to submit content that:

• You do not have the right to submit
• Is illegal or promotes illegal activities
• Contains material that exploits minors
• Is intended to abuse, disrupt, or overwhelm the Service

5. No Training on Your Content

We do not use Your Content or Output to train, improve, or develop AI models. Your Content is processed solely to provide the requested security scan and is deleted within 15 minutes. See our Privacy Policy for complete details on data handling.

6. Payment Terms

6.1 Pay-Per-Use Model

The Service operates on a pay-per-scan basis using the x402 payment protocol with USDC cryptocurrency. No subscriptions, contracts, or minimum commitments are required.

6.2 Pricing

Scan pricing is determined by content size at the time of scanning. Current pricing is available via the GET /v1/guard/quote endpoint. We reserve the right to modify pricing with reasonable notice.

6.3 Refunds

Due to the immediate delivery nature of the Service, all payments are final. If you experience a technical issue that prevents delivery of scan results, contact us at aisecurityguard@enspektos.com to request a review.

7. Intellectual Property

7.1 Our Intellectual Property

The Service, including all software, algorithms, detection patterns, user interfaces, documentation, and underlying technology, is owned by Enspektos, LLC and protected by intellectual property laws. Nothing in these Terms grants you any right, title, or interest in our intellectual property except as expressly stated.

7.2 Your Intellectual Property

As stated above, you retain all rights to Your Content and Output. We claim no ownership interest in the content you submit or the results generated from your content.

8. Usage Data

We may collect and generate aggregated or de-identified technical data relating to your access to and use of the Service ("Usage Data"). Usage Data may include information such as system logs, performance metrics, scan statistics, and other operational information but excludes Your Content or any personally identifiable information. We may use Usage Data for purposes including improving, maintaining, and securing the Service, developing new features, monitoring for abuse, and conducting analytics. We will not use Usage Data in a manner that identifies you.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY, RELIABILITY, OR COMPLETENESS
• QUIET ENJOYMENT
• TITLE

9.1 No Guarantee of Detection

WE DO NOT WARRANT THAT THE SERVICE WILL DETECT ALL SECURITY THREATS, VULNERABILITIES, OR MALICIOUS CONTENT. NO SECURITY SCANNING TECHNOLOGY IS 100% EFFECTIVE. THE SERVICE IS ONE LAYER IN A COMPREHENSIVE SECURITY STRATEGY AND SHOULD NOT BE RELIED UPON AS THE SOLE MEANS OF SECURITY PROTECTION.

9.2 AI Output Characteristics and Limitations

THE SERVICE USES ARTIFICIAL INTELLIGENCE AND MACHINE LEARNING TECHNOLOGIES, INCLUDING THIRD-PARTY LARGE LANGUAGE MODELS, WHICH HAVE INHERENT CHARACTERISTICS YOU MUST UNDERSTAND:

Non-Deterministic Outputs: AI systems are probabilistic, not deterministic. The same or substantially similar content submitted at different times may produce different analysis results, threat assessments, or recommendations. This variability is an inherent characteristic of the technology, not a defect.

Potential for Inaccuracy (Hallucination): AI systems may generate outputs that appear plausible but are factually incorrect, incomplete, or inappropriate. This includes but is not limited to: incorrect threat classifications, fabricated technical details, inaccurate remediation advice, or misidentification of security risks. Such outputs may occur without warning and without apparent indication of error.

No Guaranteed Consistency: Model updates, infrastructure changes, or third-party provider modifications may alter output characteristics over time. We do not guarantee that outputs will remain consistent across versions or time periods.

YOU ACKNOWLEDGE THESE CHARACTERISTICS AND AGREE TO:

• Independently evaluate all outputs for accuracy before relying on them
• Not treat outputs as a sole source of truth or substitute for professional security advice
• Apply appropriate human review before making security decisions based on outputs
• Accept that false positives and false negatives will occur
• Not rely on consistency of outputs over time or across submissions
• Maintain your own security validation processes independent of this Service

9.3 Service Availability

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. THE SERVICE MAY BE UNAVAILABLE DUE TO MAINTENANCE, TECHNICAL ISSUES, OR CIRCUMSTANCES BEYOND OUR CONTROL.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

10.1 Exclusion of Damages

IN NO EVENT SHALL ENSPEKTOS, LLC, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

• LOSS OF PROFITS, REVENUE, OR BUSINESS
• LOSS OF DATA OR DATA BREACH COSTS
• LOSS OF GOODWILL OR REPUTATION
• BUSINESS INTERRUPTION
• COST OF SUBSTITUTE SERVICES
• SECURITY INCIDENTS OR BREACHES NOT DETECTED BY THE SERVICE
• ANY DAMAGES ARISING FROM YOUR RELIANCE ON SERVICE OUTPUTS

REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10.2 Liability Cap

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO US FOR THE SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS (USD $100.00).

10.3 Basis of the Bargain

You acknowledge that the fees charged for the Service reflect the allocation of risk set forth in these Terms, including the limitations of liability, and that we would not provide the Service without these limitations.

10.4 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain types of damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by applicable law.

11. Indemnification

11.1 Your Indemnification Obligations

You agree to indemnify, defend, and hold harmless Enspektos, LLC and its affiliates, directors, officers, employees, agents, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the Service
• Your Content
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Your violation of any third-party rights
• Decisions made based on Service outputs without independent verification
• Any security incident related to your systems or data
• Your redistribution of Service outputs to third parties

11.2 Indemnification Scope

Your indemnification obligations apply to actual claims, demands, or legal proceedings brought by third parties. We will provide you with prompt written notice of any claim subject to indemnification and reasonable cooperation in the defense of such claim at your expense.

11.3 AI Output Acknowledgment

You acknowledge that Service outputs are generated using AI systems that may produce non-deterministic, inaccurate, or inconsistent results. You agree not to hold us liable for decisions made based on Service outputs without independent verification. We recommend maintaining defense-in-depth security practices and human review for critical security decisions.

12. Third-Party Services and AI Providers

12.1 Third-Party AI Infrastructure

The Service utilizes third-party AI infrastructure providers, including Together AI, to process analysis requests. These providers operate large language models that generate portions of the Service's outputs. You acknowledge that:

• We do not control the internal workings, training data, or output generation of third-party AI models
• Third-party providers may update, modify, or replace models without notice to us or you
• Output quality, consistency, and characteristics may change due to third-party provider actions
• Third-party AI models may produce outputs that are incorrect, biased, or inconsistent

We select providers with appropriate privacy and security practices (including Zero Data Retention policies where available), but we cannot guarantee third-party compliance. See our Trust & Security page for current provider information.

12.2 Other Third-Party Services

The Service may integrate with or rely upon other third-party services (such as the x402 payment protocol). Your use of such third-party services is subject to their respective terms and policies.

12.3 Third-Party Disclaimer

WE ARE NOT RESPONSIBLE FOR THIRD-PARTY SERVICES, INCLUDING THIRD-PARTY AI PROVIDERS, AND DISCLAIM ALL LIABILITY ARISING FROM THEIR ACTIONS, OMISSIONS, OUTPUTS, OR YOUR USE OF THEM. THIS INCLUDES LIABILITY FOR ANY INACCURATE, HARMFUL, OR INAPPROPRIATE OUTPUTS GENERATED BY THIRD-PARTY AI MODELS.

13. Modifications to Service and Terms

13.1 Service Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

13.2 Terms Modifications

We may revise these Terms at any time by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any changes constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

14. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

Sections 4.1 (Ownership), 7-11 (IP, Usage Data, Disclaimers, Liability, Indemnification), 15-17 (Governing Law, Dispute Resolution, General) shall survive termination.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in New York County, New York for resolution of any disputes.

16. Dispute Resolution

16.1 Informal Resolution

Before initiating any formal dispute resolution, you agree to first contact us at aisecurityguard@enspektos.com and attempt to resolve the dispute informally for at least thirty (30) days.

16.2 Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in New York, New York, and judgment on the arbitration award may be entered in any court of competent jurisdiction.

16.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.

17.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

17.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

17.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

17.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
